À l’aide de robots qui scrutent le web, elles cherchent à identifier et à punir toute violation des droits d’auteur, souvent avec une avidité démesurée. Cette approche agressive dépasse parfois les limites de la justice et devient une véritable chasse aux sorcières, visant le public lambda qui n’a peut-être pas conscience des subtilités des lois sur les droits d’auteur.
En se concentrant uniquement sur la protection des droits d’auteur et la maximisation des revenus, ces sociétés semblent avoir perdu de vue l’esprit d’entraide, de partage et de bon sens qui devrait nous guider en ces temps troublés. Au lieu de favoriser la créativité et l’échange, elles créent un climat de méfiance et de peur, nuisant ainsi à la richesse culturelle et à l’épanouissement des artistes.

We received your email dated March 20, 2023, regarding case no. 275A7C and the alleged unauthorized use of an image belonging to your client, Dick van Duijn, on our website https://www.ease.fr/.
After a thorough review of your request and the information provided, we have decided to firmly reject this demand, which we consider dishonest and constituting an abuse of copyright.
It is important to note that copyright protects only original and creative works. In the case of Bridgeman Art Library v. Corel Corp., 36 F. Supp. 2d 191 (S.D.N.Y. 1999), it was ruled that photographic reproductions of nature / public domain works of art are not protected by copyright, as they do not exhibit the required level of creativity. We believe that the image in question in this case does not meet this criterion of originality and creativity.
Furthermore, under Article 5(3) of Directive 2001/29/EC of the European Parliament and the Council of 22 May 2001, there are exceptions and limitations to copyright. We believe that the use of the image in question on our website falls under the quotation exception (Article 5(3)(d)), which allows the use of protected works for the purposes of criticism or review, provided that the source, including the name of the author, is indicated.
We consider our use of the image to be in line with copyright principles and applicable exceptions. Therefore, we refuse to comply with your payment request for the alleged unauthorized use of the image.
In addition, we would like to point out that the author himself made this image available on Facebook. By posting the image on this platform, the author accepted Facebook’s terms of use, which stipulate that users grant a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license for the use of copyrighted content they publish. Consequently, by sharing the image on Facebook, the author implicitly waived certain exclusive rights over the sharing of this image.
Our intention in using this image was to promote the artist’s work and contribute to their visibility. We acted in good faith and in accordance with copyright principles.
Furthermore, we would like to emphasize that our website, as well as our non-profit organization, operate without any advertising or commercial purpose. We have not derived, nor do we derive, any financial benefit from the use of the image in question. This further demonstrates our good faith and intention to promote the artist’s work without any intention of unjust enrichment.
Moreover, we would like to inform you that upon receiving your complaint, we have immediately removed the image in question and the related publication from our website. Although we maintain our position that the use of the image was lawful and within the scope of copyright exceptions, we have taken this action in good faith to avoid further disputes and show our willingness to address your concerns.

Salut ! Aujourd’hui un post de bienvenue pour notre nouveau Coq ici à la ferme des Coges (64). Depuis 7 ans que je suis là c’est mon troisième Coq ici. Celui là est un Brahma noir de 9 mois. Je l’appelle Dédé pour Devrig mon ami perdu il y a peu. Ca sera comme un pied de nez à l’histoire. Devrig sera enfin venu ici nous rejoindre.
Depuis qu’il est avec nous il nous fait trois chansons par jour. Poule Renoie ne le supportait pas au début, ca va mieux maintenant.
Bienvenue donc à Dédé le Coq avec qui on va faire un bout de route.
De la gare d’Austerlitz à la place de Clichy Paris n’était que désolation.
C’était un taxi et non un Uber, alors je ne connais pas son nom. Lui non plus ne connaît pas le mien d’ailleurs. Voilà qui devient rare.
Quand j’ai embarqué, le taximan qui attendait derrière lui dans la file a applaudi. Avec le narcissisme qui me caractérise, je me suis dit qu’il félicitait son collègue et concurrent pour avoir embarqué une charmante jeune femme (si si) à l’air de gitane (je suis toujours chargée comme un baudet quand je rentre de vacances, en réalité je ressemble davantage à une mendiante rom, mais un peu d’érotomanie du quotidien ne fait de mal à personne surtout par les temps qui courent). Ces mignonnes félicitations entre coqs roulants eussent été possibles, mais seulement monde d’avant…
Or nous étions en octobre 2020, et le reconfinement avait été déclaré.
Une fois à bord, il m’a expliqué. Qu’en huit-neuf ans d’asphalte jungle c’était la première fois qu’il n’avait fait qu’une seule course de la journée, à savoir moi. Voilà trois heures qu’il attendait dans cette file, du côté de la place de Clichy. D’où les applaudissements de son collègue. Voilà ce à quoi avaient conduit les errements néo-libéraux de ceux de là-haut. L’Hôpital qui suffoquait, les gens enfermés, les petits commerces qui crevaient, pendant qu’Amazon triomphait.
Il était comme sidéré.
On s’est dit que monde semblait être devenu fou.
On s’est dit que ça allait péter, parce que bientôt il n’y aurait plus de billets pleuvant, façon feu d’artifice, pour éteindre les braises. Parce que bientôt de plus en plus de gens allaient avoir faim. Ou froid. Ou les deux.
Showman roulant, il m’a fait rire en me racontant les couillons qui, DE NOUVEAU, avaient fait deux heures de queue pour des stocks de papier cul. « Les gens sont cons, mais cons ! », m’a-t-il dit. C’était peut-être ça, le problème ? Nous étions arrivés. Il m’a aidé à sortir ma valise du coffre, on s’est regardés, yeux-par-dessus-masque, et on s’est dit : « Bon courage. Prenez soin de vous ». Du fond du cœur.
